2. Seller Responsibilities

Sellers agree to:

  • Accurately represent the condition and quantity of listed items.
  • Upload only photos they own or have permission to use.
  • Comply with all applicable federal, state, and local laws.
  • Remove listings that are no longer available.

3. Buyer Responsibilities

Buyers are responsible for:

  • Reviewing listing details carefully.
  • Contacting sellers directly with questions.
  • Inspecting materials before purchasing whenever possible.
  • Verifying suitability for their intended use.

4. Payments

At this time, payments for listed materials are arranged directly between buyers and sellers unless otherwise stated.

Listing fees paid to BuildSmart Surplus are non-refundable once a listing has been published.

5. Prohibited Listings

The following may not be listed:

  • Illegal products
  • Stolen materials
  • Hazardous materials prohibited by law
  • Counterfeit products
  • Fraudulent or misleading listings
  • Materials that violate intellectual property rights

BuildSmart Surplus reserves the right to edit, reject, or remove any listing that does not meet marketplace standards or that is determined to be misleading, inappropriate, or inconsistent with the purpose of the website.

6. No Warranty

BuildSmart Surplus makes no guarantees regarding:

  • The accuracy of listings
  • Seller reliability
  • Buyer reliability
  • Material quality
  • Availability of listed items

All purchases are made at the buyer’s own risk.

7. Limitation of Liability

BuildSmart Surplus shall not be liable for any damages, losses, disputes, injuries, or claims arising from transactions between buyers and sellers.

8. Account Termination

BuildSmart Surplus reserves the right to suspend or terminate accounts that violate these Terms of Use or engage in fraudulent or abusive activity.
